Molson Coors Beverage Company SMS Terms & Conditions – Canada Policy

Please read these SMS Terms & Conditions (the “SMS Terms”) carefully. By enrolling or otherwise agreeing to receive text messages from or on behalf of Molson Coors, you agree to these SMS Terms, as well as Molson Coors' Terms and Conditions, which are incorporated herein by reference and considered a part of these SMS Terms, and, except where prohibited by law, include a mandatory arbitration provision (which requires that disputes are resolved by final and binding arbitration on an individual, not a class-wide basis), grants us certain rights and licenses, provides us certain indemnities, waives certain of your rights and remedies, and limits our liability and obligations to you.
If you are agreeing to these SMS Terms on behalf of a business customer, you represent that you are an authorized representative of your organization for purposes of receiving business communications. You further represent that you are the current subscriber or authorized user of the phone number provided and agree not to initiate messages to the mobile phone of any other person or entity without authorization.
ARBITRATION NOTICE (EXCEPT FOR CONSUMERS IN QUEBEC, ONTARIO, AND WHERE PROHIBITED BY LAW): THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION. UNLESS YOU ARE A CONSUMER RESIDING IN A JURISDICTION THAT PROHIBITS EXCLUSIVE ARBITRATION CLAUSES (SUCH AS QUEBEC OR ONTARIO), YOU AGREE THAT DISPUTES WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS, AND YOU WAIVE YOUR RIGHT TO A CLASS ACTION.
By enrolling in this program, you confirm that you were provided the opportunity to view these SMS Terms in French which are available online. In Québec, messages will be provided in French unless you have expressly requested communications in English.
To the extent of any inconsistency, the SMS Terms in this document will apply to our text messaging programs. Please also review our Privacy Policy. For purposes of these SMS Terms, “Molson Coors,” “the Company,” “we,” or “us” shall mean Molson Canada 2005 and any of its subsidiaries, divisions, or affiliates.
Participation in text message program
Molson Coors offers two different text message programs: One for its business customers (retailers, restaurants, bars, venues etc.) (the “B2B Program”), and one for its end-purchaser customers (the “Customer Program”).
B2B program
If you are a business customer of Molson Coors, or an employee or representative of such a business customer and acting on their behalf, by providing a mobile telephone number to Molson Coors (including via myMolsonCoors, to your Molson Coors representative, or through our websites or mobile apps), you agree that we may send you recurring text messages related to your business account and commercial relationship with Molson Coors.
These messages may include account notifications such as order cut-off reminders, delivery notifications, payment or invoice alerts, new document availability, and other communications concerning the activities of your organization. You may also receive related messages for that program (e.g., offers, deals, sweepstakes). Messages may be sent by or on behalf of Molson Coors using an automated system. Messages will identify Molson Coors as the sender and include information on how to unsubscribe. Program or message frequency may vary.
Customer program
To participate in Molson Coors customer text messaging program(s), please follow the instructions provided by Molson Coors, which may include texting a message to a short code, providing us with your phone number online at our website or mobile app, or otherwise providing your consent. You may need to confirm your consent, such as by replying “Y” or through another designated response to an initial text message sent to you.
Eligibility
To enroll in our text message programs, you must be the mobile account holder, a resident of Canada, and be of legal drinking age in your province or territory of residence. You may need to confirm your age by providing your date of birth in response to a text message sent to you. Your consent to text messages will apply to the specific brands to which you consent to receive text messages from.
Delivery and carrier terms
We may not be able to deliver messages to all mobile carriers or in all areas. Some carriers or devices may not support some services (e.g., certain pre-paid plans). Check with your carrier. Molson Coors and mobile carriers are not responsible or liable for undue delays, failure of delivery, or errors in messages. Messages may be delivered via Canadian common short codes, approved toll-free SMS, or other carrier-approved sender IDs.
Consent not a condition
Consent (where applicable) to receive text messages is not a condition of purchasing any goods or services or obtaining a sweepstakes entry. Messages may be in SMS, MMS, or RCS format. Message frequency may vary.
How to opt out and get help
To stop receiving text messages from Molson Coors, reply STOP or ARRET to the number sending the message. After opting out, you may receive one final text message confirming that you have opted out. If you opt out of one Molson Coors text messaging program, you will remain opted into other Molson Coors text messaging programs (if applicable) unless you opt out of those programs separately. For help, reply HELP, AIDE, or INFO to the number sending the message, or contact Molson Coors at 800-645-5376.
Message and data rates
Standard message and data rates may apply for any messages sent to you from or on behalf of Molson Coors, and for messages you send to us. If you have any questions about your text or data plan, please contact your wireless provider.
Privacy and data processing
We handle your personal information, including your mobile number, in accordance with our Privacy Policy. Your information may be processed by Molson Coors or its service providers (e.g., messaging platforms) outside your province or outside Canada.
Change in phone number
If you intend to or do change, forfeit, or deactivate the phone number you have provided to Molson Coors, you agree to promptly notify Molson Coors by contacting 800-645-5376 or by replying STOP / ARRET to the applicable short code. Molson Coors may transition from one short code or telephone number to another, and you consent to receive messages from the new short code or number.
Changes to the SMS terms
These SMS Terms may be revised, modified, or amended by Molson Coors at any time without prior notice and any. Any such revision, modification, or amendment shall take effect when posted to our website with an updated “Last Modified and Effective Date,” or upon notice to you where required by law. By continuing to participate in any Molson Coors text messaging program, you agree to any changes to these SMS Terms.
